New Texting and Driving Penalties
With texting and driving responsible for more than 1.6 million accidents nationally per year, New York is increasing the penalties for distracted driving.
From 2005-2011 there has been a 143% increase in cell-phone related crashes in New York, out numbering the amount of alcohol related crashes. Under New York State Law, it is illegal to operate your phone while you drive, unless you are calling 911 in an emergency situation.
According to the National Highway Transportation Safety Administration, texting and driving is as dangerous as driving after drinking 4 beers. Because of this recent rise in activity, the Department of Motor Vehicles has increased the number of points to 5 for those convicted of texting behind the wheel.

Along with an increase of points on your license, the fines will increase as of July 26. Here are the increased fines:
• First offense is a minimum fine of $50 and maximum fine of $150.

• For a second offense committed within 18 months, the minimum is $50 and the maximum increases to $200.
• For a third or subsequent offense committed within 18 months, the minimum fine is $50 and the maximum fine increases to $400.
