New Measure Gives Town Attorney Power to Cease Illegal Operations

Town board approved new measure Tuesday.

Town of Smithtown Attorney John Zollo will now have the ability to seek a court injunction to cease illegal operations within the town, according to a report on the Times of Smithtown.

The purpose of the injunction would be to stop illegal activity during the sometimes lengthy court process that occurs when dealing with violations.

The report cites two examples where the measure could be used; the Hightowner Homes and the Industrial Area of Kings Park.

So howcome they will not just have Code Enforcement issue a "STOP WORK" order? What are their legal bounderies? WHO is making sure they stay within them? WHO is giving them this 'Power" ?

According tot the article (link posted by San Remo) Zollo indicated that the impetus for the law was to get rid of two abandoned houses on 25A not the illegal businesses along Old Npt Road. Interesting factoid - Zollo was partners with Trimarco (the lawyer representing Carlson & the other businesses seeking the zoning change to heavy industrial) for several years prior to his return to the Town's attorney position. Conflict of interest?

stop work order was issued. the neighbors are still living next to an eyesore. you can force them to stop....you cant force them to make things right. the owner of the "hightower" houses is in jail. i dont think hes ready to bang nails right now.
